The article attempts to present the definition of swap. Considerations presented stem from the fact that the Polish legal system lacks this definition. The jurisprudence that applies the swap concept and the literature of the subject indicated in the article allow to gather and put in order several characteristics that can be regarded as constitutive features enabling to define the concept of swap.
