The article is dedicated to the issue of the new consensual form of ending criminal proceedings. The subject of the analysis is voluntary submission to a penalty by the defendant in the court’s session of ordinary justice, as the institution provided in amendment to the Code of Criminal Procedure by the act of 27th september 2013. The author verifies this institution in the context of general evaluation of consensual end to criminal proceedings and in the context of prerequisites of regulation mentioned above. As a result, author draws ambiguous conclusions, because it’s a also consequence of the critical analysis related to rules and way of extending consensual procedural forms.
