The article presents the institution of substitute imprisonment announced as replacement of court fine based on the regulations of the Penal Executive Code considering views presented in the doctrine and judicial decisions. The article also accents practical problems connected with announcing and executing the substitute imprisonment by a court on the basis of author’s experience got during work in a district court. It often happens, that commentaries finish where real problems begin.
