The article concerns the problem of forensic psychiatric opinions in cases of insane perpetrators. It emphasizes the necessity to obtain an up-to-date expert opinion before adjudicating a preventive measure, the requirement to justify the necessity to apply a preventive measure, as well as the lack of competence of expert psychiatrists to provide opinions on the legal grounds for applying a protective measure, in particular assessing the degree of social harmfulness of a prohibited act.
