The Supreme Court has ruled that in the case when both the testator and the heir have contributed to a cessation of family contacts, disinheritance is permissible pursuant to Art. 1008 item 3 of the Civil Code. Such a view does not deserve approval. Disinheritance due to a persistent failure to fulfill family responsibilities is possible only if the heir, unlike the testator, does not perform these duties, which in turn leads to a cessation of emotional ties. If such a disinheritance is ineffective, it is possible to reduce the legitim on the basis of Art. 5 of the Civil Code.
