The recording of the course of the main hearing in a criminal procedure by the representatives of mass media (Article 357 of the Code of Criminal Procedure)

The subject of the article are the issues concerning the recording of the course of the main hearing in a criminal procedure by the representatives of mass media – after the change of the Article 357 of the Code of Criminal Procedure. Presently it is unconditionally permitted for the representatives of mass media to record the course of the main hearing. Only in exceptional case, when the presence of the representatives of mass media could have an unfavourable influence on the testimony of the witness, the presiding judge may order them to leave the room. Any other cases of the unfavourable influence of the presence of the representatives of mass media up on the evidential proceedings cannot be the ground of leaving the room by them. In case of the conflict between the principle of open main hearing and endeavor to obtain the full possible evidence, priority is given to the principle of main hearing openness. It may lead however to the limitation of the principle of the material truth.
