This article presents the legal situation of a spouse who is a partner in the civil law partnership as well as the legal situation of spouses who are both partners in the civil law partnership established by themselves. The appurtenance of so called “partnership rights” regarding the moment of establishing the civil law partnership has been given under discussion. The article provides a description of the responsibility of a spouse who is a partner in the civil law partnership as well as the legal situation of spouses who are both partners in the civil law partnership established by themselves. There is a large of problems concerning issues of defining the responsibility of the partners in the civil law partnership who are being in the legal spousal community. A.m. issues appear especially when the civil law partnership was established while covered by the joint property of spouses.
