This study deals with the issue of agreements excluding evidence in civil court proceedings. This issue has not only theoretical but also practical value. Until now, the agreements excluding evidence raised serious doubts because they had no regulations in the Code of Civil Procedure. After the amendment to the Code of Civil Procedure, the legislator decided to introduce the regulation of evidence contracts. Evidence agreements have been regulated in art. 458(9) Code of Civil Procedure This is a significant regulation. The study deals with the nature of agreements excluding evidence, including their admissibility, legal nature and defectiveness. The article also assesses the issue of admissibility of agreements excluding evidence due to procedural rules and the Polish Constitution.
