The polemic concerns the article authored by dr hab. Magdalena Matusiak-Frącczak, who proposed limiting the priest-penitent privilege pertaining to the commission of sexual offences against minors. The polemic concerns, first of all, the reasoning of the proposition that the act of confession belongs to the so-called forum externum of the freedom of religion, and also the legislative diligence of limiting the secrecy of confession only in relation to „paedophilic” crimes, while maintaining it in the case of other, serious offences of which minors are victims. What also raises the polemicist’s doubts – in terms of the principle of proper legislation – is the proposal to limit the priest-penitent privilege, while simultaneously abandoning such interference in the lawyer-client privilege. Though appreciating the courage of the author of the article and the expediency of discussing the topical issue, the polemicist expresses reservations regarding the way in which she justifies the position presented in the work.
