The article presents the problem of determining the moment when an offence is committed under the conditions of continuity, the essence of which is an extension in time of the causative activity understood as a single act. Considerations on this subject also have to take into account the possibility of a time discrepancy between the commission and the completion of the offence. Determining the moment of commission is of normative importance, as it allows for the correct delimitation of an attempt as an earlier stage of the offence. In relation to a continuous offence, it is very difficult in practical terms, because it is based on a subjective criterion of the intention formed in advance.
