The subject of this article is a collision of a complaint to a court of second instance and a complaint to a different panel of court of first instance in civil proceedings (in examination proceedings and in enforcement proceeding). The text present also an analysis of the situation when the provisions of law allow the party to file a complaint against the judgement, but do not indicate the jurisdiction of court to examine such complaint.
