In the article, the author analyses fear of obstructing justice, defined in Article 258(1)(2) of the Code of Criminal Procedure, which constitutes grounds for the application of pre-trial detention. It is a situation when there is a justified fear that the accused will induce false testimony or statements, or unlawfully obstruct criminal proceedings. The fear of obstructing justice must be real, specific and justified by facts; it cannot be general or presumed, supported only by the fact that the accused did not plead guilty, thus he/she will take steps that will obstruct the proper course of the proceedings.
