A review of the Supreme Court’s case law in civil matters

In the first part of the review the authors analyse two rulings of the Supreme Court in which the Supreme Court has answered legal questions submitted by the common courts. In the first ruling the Supreme Court explained the responsibility of the co-owners of premises for payment of advances on the costs of the management of the common immovable. In the second ruling the Supreme Court considered a problem whether a creditor can claim late interest in commercial transactions in a case of bankruptcy of the debtor. In the second part of the review the authors comment on two rulings of the Supreme Court. In the first ruling the Supreme Court stated that an injured person should have a tortious capacity to be attributed contributory negligence to the damage. In the second ruling the Supreme Court answers the question of the priority of satisfaction of claims when the legal act has been ruled ineffective to the benefit of a creditor who has brought an actio pauliana against a third party with whom the debtor has entered into a legal act in detriment of the creditor.
