Spouses who are Polish citizens domiciled in the United Kingdom can commence the divorce proceedings before a Polish court, pursuant to Art. 11031(1)(4) of the Polish Code of Civil Procedure. When the spouses have minor children in common, the Polish court has jurisdiction to establish child/spousal maintenance. In matters of parental authority and contact with children, a British court will have jurisdiction as the court of the child’s habitual residence, pursuant to the Hague convention, ratified by both Poland and the UK. The lack of unified jurisdiction in the matter of children in divorce proceedings is problematic and may provoke further conflict between ex-spouses.
