The paper disputes statutory settlement of the meeting on compensation for unjust conviction, detention on remand or detention which is to be identified by a judge subordinated to the president of the court where the latter is acting as a party in this case. The view expressed is that the abovementioned legislation does not favour the impartiality of the court with regard to the subjective and objective aspect. The legislation fails to create the necessary trust which the court must have in the public and as such it meets not the requirement of procedural fairness, since it does not ensure an unbiased and thus fair hearing of the matter and the decision on it.
