The subject of this paper are planned changes of the Polish Penal Code concerning negligence. The Criminal Law Codification Commission presented a preliminary proposal of an amendment to general part of the Penal Code. Among the proposals there is an essential change of normative description of negligence. The subject to the changes should be among others Article 1, Article 2, Article 9 and Article 28 of the Penal Code. These are regulations concerning the structure of the crime, the responsibility for the crime committed by omission, mens rea of the offence and the mistake. The author makes a critical analysis of the proposed changes. Among others, she is in favour of leaving in the Article 9 § 2 of the Penal Code the condition of predictability. The author assesses positively the removing from the Article 9 § 2 of the Penal Code an element of disobeying of caution applying in given circumstances and the repealing of the current Article 28 § 1 of the Penal Code.
