Effecting 1 January 2012, the activity of the district committees adjudicating on medical events has commenced. Those authorities have been granted by the legislature the power to issue a specific certificate. This certificate constitute an enforcement title and thus may be challenged using adverse claim based on Article 840 point 1 in conjunction with Article 8402 of the Polish Civil Procedure Code. The scope of allowable plaintiff charges depends on whether the certificate has been issued as a result of the insurer omission on the preliminary or final stage of the procedure.
