Lowering the standard of proof of causation in „medical processes”

Proving a causation link between medical malpractice and the injury suffered by the patient is one of the particularly difficult requirements set upon the plaintiff by the legislator. In „medical processes”, the very fact that the memage has occured is often uncontested, and the subject of the dispute remains causation. At the same time, exact proof of causation can be impossible to indicate due to the dynamic course of the disease, the multiplicity of factors affecting its development, or the imperfection of medical knowledge. In this context, the purpose of the article is to show that in the practice of judicial application of the law in „medical processes” it is not required to strictly prove an adequate causal relationship.
